“A democracy is nothing more than mob rule, where fifty-one percent of the people may take away the rights of the other forty-nine.”
Thomas Jefferson
Well thanks to great men like Jefferson, the United States is a Republic! Mob rule is exactly what we have here in this Proposition 8 decision by the California Supreme Court. This decision goes against everything this country stands for by accepting the will of the many to deny the right of the few. Because of that, this should have never come up for a damn vote to begin with.
Tell me if this sounds familiar: If you are this… well you can go here or do that… but if you are that… then you cant go here or do that even though this can. Proposition 8 does nothing more than segregate a certain populace of California and denies them equal rights.
Here is what Supreme Court Justice Earl Warren had to say regarding the Brown vs. Board of Education ruling on segregated schools: “We conclude that in the field of public education the doctrine of ‘separate but equal’ has no place. Separate educational facilities are inherently unequal.”
Another argument that has greatly amused me is.. .”well Woody gay people have the right to marry… they just have to be the opposite sex”. I will grant you that a gay man can marry a woman.. and a lesbian can marry a man. Lets say, just for the hell of it, that a gay man married a woman. Doesn’t that invalidate the entire argument of protecting the sanctity of marriage? While I often question the sanity of anyone who willing wants to get married… why do two people get married? Because they are the opposite sex? I dont think so. Last I checked two people fell in love, realized they were forever committed to one another and then held a ceremony to celebrate such love. That is what marriage is about and most have apparently forgotten that especially those trying to “protect the sanctity of marriage”. No wonder divorce rates are so high.
A gay man.. is not going to have that sort of love for a woman. HE’S JUST NOT. Yes, it happens.. but how many of those marriages actually WORK? How many end up getting hurt because of it? That argument only further destroys the sanctity of marriage. It doesn’t matter anyway. That is not who they are as individuals and they should not have to compromise their individuality in order to appease an ignorant majority. Last I checked.. this country still believes in the right of the individual.
“But Woody.. the Bible says…”.. oh.. right right right. The Bible. I keep forgetting about that thing. Hmm well Ill tell you what.. if people are so concerned with what some book (supposedly) says.. or what a particular faith believes… fine. Government cannot recognize any law respecting the establishment of religion. Therefore, no government under the United States Constitution can recognize “marriage”. The government should only recognize Civil Unions, this includes all unions recognized as “marriage” retroactively and any new union… for every American. You wanna get married? Go to a church. Problem solved.
So what did we learn today? We have learned about the hypocrisy of some who would normally whine about “activist judges” until the ruling suits their needs. We learned that we haven’t even learned from our own history. We learned… that we have a hell of a lot to learn.

I don’t get where this idea marriage was something you do because you love someone comes from.
Read your history. The concept of a love marriage is very new, only a couple of hundred years old, before that there were occasional romantic stories, but the vast majority of marriage was about cementing family ties, economics etc.
Marriage and love are connected, but the love is something that comes after the marriage. Almost a sort of duty.
If we were talking about certain historic marriages I would certainly agree with you especially where royalty is concerned.
However, even taking this concept of marriage that you propose certainly shouldn’t be a right exclusive to one and denied to another.
Woody,
I think you make a very good point about the constituion saying “Government cannot recognize any law respecting the establishment of religion.”
Fighting against “gay marriage” is like fighting the tide coming in. Over time, personal rights only expand, not recede. It WILL happen.
Besides how does anyone else’s definition of marriage affect my marriage? Or yours?
Put religion aside. Heck, put love aside. Marriage is a business. Two people get married for whatever reason, share a home, other assets, maybe kids. They share expenses and income, and get tax and estate benefits from the arrangement. Straight people have that right. Gay people don’t. It is discrimination just like segregation . . . just like not allowing women and people of color to vote. People are all human beings . . . let them all share the same rights or take those rights away from everyone.
